About Your Traffic Ticket

Traffic tickets can have a negative effect on your driver’s license. When your demerit points reach certain points, you license may be suspended and your insurance premium could increase significantly.

Although drivers can choose to appear in traffic court without legal representation, but the outcome could be very different. Especially when there are demerit points involved and the offence is more serious.

You should also know:

  • Most traffic tickets for moving violations have demerit points.
  • If the ticket goes on your driving record regardless of demerit points the ticket can be seen by your insurance company.
  • Traffic tickets are classified as minor or major by insurance companies.
  • Traffic tickets stay on your driving record for three (3) years.
  • Tickets for G1 or G2 driver’s violations have a mandatory 30 day license suspension.
  • It’s your right to fight the ticket – even if you think you committed the offence and are guilty.

Speeding

Speeding Even a minor speeding ticket has more penalties than the fine listed on the ticket. Speeding tickets can affect your insurance rates and your ability to drive for many years. Insurance companies are constantly looking at speeding tickets and any traffic ticket as an opportunity to increase the insurance premiums for the driver.

Stunt Driving

Stunt Driving Tickets / Speeding more than 50km/h / Racing

Stunt Driving Tickets have serious penalties that affect your ability to drive, insurance rates and your employment.

Stunt Driving tickets have the following penalties;

  • Immediate seven (7) day license suspension
  • Minimum fine of two thousand ($2000.00) dollars
  • License suspension of up to two years
  • Seven (7) demerit points
  • Imprisonment for a term of not more than six (6) months
  • Dramatic increase of insurance rates
  • Second conviction drivers licence suspension of up to ten (10) years

Red Light

The fine attached to a red light ticket is not the only penalty for the ticket. A red light ticket has four different penalties:

  • Three demerit points
  • A three hundred and twenty five ($325.00) dollar fine
  • A conviction registered on your driving record for three years
  • Possible insurance increases
  • Determination of fault in accident cases

Stop Signs

The fine attached to a stop sign ticket is not the only penalty for the offence. A stop sign ticket has four different penalties:

  • Three demerit points
  • A fine of one hundred and ten dollars ($110.00)
  • A conviction registered on your driving record for three years
  • Possible insurance increases
  • Determination of fault in accident cases

Careless Driving

Careless driving tickets can affect your right to drive and your insurance.

  • A conviction for careless driving ticket will increase your insurance dramatically.
  • A conviction for careless driving can affect your employment.
  • Careless driving tickets have 6 demerit points.
  • Careless driving tickets have license suspensions for G1, G2 Drivers.

Fail To Remain

The penalty for Fail to Remain under the Highway Traffic Act is;

  1. A fine not less than four hundred (400) dollars and not more than two thousand.(2000.00) dollars.
  2. Imprisonment for a term of not more than six months, or to both.
  3. Six (6) demerit points.
  4. Possible licence suspension for up to two (2) years.

No Insurance

Fail to Surrender Insurance Permit or No Insurance or False Insurance Under the Compulsory Automobile Insurance Act of Ontario the owner of a motor vehicle is responsible for insuring that the vehicle is covered with liability insurance before the vehicle is driven on the roadway. Upon demand from a police officer the driver must produce valid evidence of insurance.


The fine for driving without insurance is five thousand ($5000.00) dollars, plus a surcharge (tax) of approx. twenty percent (20%).

Ontario Demerit Point System Highlights

Fully licensed drivers may accumulate fifteen demerit points, but upon reaching nine (9) demerit points the Ministry of Transportation will require an interview to discuss whether the license should be suspended.

If a probationary driver receives any four (4) point traffic ticket the Ministry of Transportation will suspend the licence for thirty (30) days.

If a class G driver reaches fifteen (15) demerit points the Ministry of Transportation will suspend the driver’s licence for thirty (30) days, and six (6) months for any subsequent accumulation of demerit points.
